SpiritSingles.com, Inc. - Terms and Conditions of Purchases

All purchases are subject to the following terms and conditions:

SpiritSingles.com, Inc. subscription fees are billed monthly at the following rates:

1 Month Subscription          $24.95      [at a monthly renewal rate of $17.95 thereafter]

3 Month Subscription          $47.85       [at a monthly renewal rate of $15.95 after the initial 90 day period]

6 Month Subscription          $79.95       [at a monthly renewal rate of $13.95 after the initial 6-month period]

12 Month Subscription        $99.95       [at a monthly renewal rate of $9.95 after the initial 12-month period]

After the expiration of your initial Subscription, your renewal rate will be automatically activated. You may revert your Subscription (revert to Free Member status) at any time by going to Member Services and clicking on the "Revert to free membership" button.

If you revert your paid Subscription to a Free Membership, your paid Subscription period continues until it's expiration at which point you revert back to Free Member status. Your profile will still be listed so that other members may contact you, and you will no longer be billed.

For example: if you chose a one-month Subscription, your renewal rate will be automatically activated at a $17.95 per month renewal rate after your 30 days are completed. If you have a three-month Subscription, your renewal rate will be automatically activated at a $15.95 per month after your 90 days are completed. You may revert your Subscription to a Free Membership at any time. You will only be billed at a per month rate based on the Subscription term you choose. You may find it more cost effective to choose a longer Subscription, so your renewal rate will be less per month.

Additional terms and conditions:

1. All Subscription purchases are final. No refunds will be given for unused portions of your Subscription period.

2. SpiritSingles.com, Inc. guarantees that e-mails sent by a Member will be processed by the SpiritSingles.com, Inc. system and sent to the addressee. Notwithstanding, SpiritSingles.com, Inc. does not guarantee a response from the recipient, nor does it make any other promises or warranties of any kind.

3. Member hereby acknowledges and agrees that his/her Subscription privileges are non-refundable in the event that Member chooses to revert or cancel his/her membership. Furthermore, no refund will be made in the event of termination of Member's Subscription due to a violation of the Terms and Conditions of service as outlined here.

4. SpiritSingles.com, Inc. shall, from time to time, shut down it's server in order to perform routine maintenance and upgrades to the system. SpiritSingles.com, Inc. will use its reasonable efforts to perform maintenance and upgrades during non-peak, early morning or late evening hours. SpiritSingles.com, Inc. endeavors to have the content of SpiritSingles.com, Inc. and its Member profiles available for access by third parties 99% of the time ("Service Availability"). In the event that the Service Availability is less than 99% during any given month, then SpiritSingles.com, Inc. will refund the prorated portion of any unused portion of the Member's monthly payment. Notwithstanding the foregoing, SpiritSingles.com, Inc. will not be liable for any delay or failure to perform its obligations, where such delay or failure results from any act of God or other cause beyond SpiritSingles.com, Inc.'s reasonable control (including, but not limited to, any mechanical, electronic, communications or third-party supplier failure).

5. All disputes arising out of or relating to FULL memberships, other e-mailing privileges or any other purchase made within the SpiritSingles.com, Inc. website shall be submitted to and settled by arbitration in accordance with the rules of the American Arbitration Association (or any other form of arbitration mutually acceptable to the parties involved). The decision made pursuant to such arbitration shall be binding and conclusive on all parties involved; and judgment upon such decision may be entered in the highest court of any forum, state or federal, having jurisdiction. All such arbitration shall take place in Miami, Miami-Dade County, Florida.

6. By submitting this purchase, Member hereby acknowledges, agrees and authorizes SpiritSingles.com, Inc. to renew Member's Subscription, automatically, every month, at the guaranteed renewal rate that applies to the membership option chosen by the Member, until such time as Member notifies SpiritSingles.com, Inc. to revert (or cancel) the Subscription to a Free Membership. Renewals can be reverted by going to "Member Services" and clicking on "Revert to Free Membership".
